On May 11, 2023, the Cannabis Control Board adopted revised draft regulations for New York’s adult-use cannabis industry. The most notable amendments include, but are not limited to, the following:

  • Details for seeking discretionary relief from the buffer zone requirements related to retail dispensaries;
  • Regulations permitting onsite consumption areas at retail dispensaries;
  • Regulations for delivery licenses and operations;
  • Amended requirements on what constitutes a True Party of Interest and a Passive Investor;
  • Regulations addressing receivership;
  • Regulations for cannabis events; and
  • Regulations for medical cannabis companies entering the recreational market.

The draft regulations are subject to a 45-day comment period and are expected to be adopted during Q3 of 2023.
