Attorneys from Cuddy & Feder’s Land Use and Energy & Environmental Practice Groups submitted comments on the proposed revisions to the DEC Freshwater Wetlands Regulations (6 NYCRR Part 664) scheduled to go into effect in January 2025. The comments describe the negative effects on landowners and developers across the state, which include costly project delays and loss of property value, as well as broad negative impacts on the State’s priorities on housing development, renewable energy projects, and environmental justice communities.
The comments also suggested specific changes that would balance wetlands preservation with the State’s climate and housing goals, while minimizing the burdens on property owners and businesses.
Cuddy & Feder’s Attorneys monitored both virtual Public Hearing Sessions on the proposed regulations on Tuesday, September 8, 2024, and submitted its comments by the close of the public comment period for the proposed regulations on Thursday, September 19, 2024.
