Southern District of New York Dismisses Multimillion Dollar Lawsuit Against Former Officers and Directors

The Cuddy & Feder litigation team of Joshua Kimerling and Brendan Goodhouse won a motion to dismiss on behalf of a group of former officers and directors of a biotech company in a multimillion-dollar lawsuit in the Southern District of New York. The plaintiff asserted that the individual officers and directors were personally liable for his alleged damages from what he claimed to be a fraudulent transaction. The Court dismissed the plaintiff’s claims against our clients holding that plaintiff had failed to establish the Court’s personal jurisdiction over the officers and directors.
