Cuddy & Feder Secures Approvals for Cannabis Production in Ancram, NY
Attorneys in Cuddy & Feder’s Cannabis Law Group secured local zoning approvals for an agricultural operation to cultivate cannabis in Ancram (Columbia County), New York. The property is classified in a County Agricultural District, and utilizing the provisions of New York’s Agricultural & Markets Law, our attorneys obtained Abbreviated Site Plan Approval from the Planning Board for an approximately 13,000 square foot greenhouse and supporting agricultural structures for the cultivation of cannabis. Cuddy & Feder successfully argued that the project was considered a 'Type II Action' under the State Environmental Quality Review Act and, therefore, exempt from environmental review. Cuddy & Feder navigated several potential obstacles in the Town’s Zoning Code, including how greenhouses are defined, limitations on fence heights, and restrictive setback provisions explicitly for greenhouses.
