Managing Unneighborly Conflicts
Neighboring property owners occasionally disagree, often when one embarks on a construction project. One developer-client’s neighbor went so far as to make multiple motions to the Westchester County Supreme Court and the Appellate Division, Second Department, for an injunction seeking to enjoin their client’s construction project in Mount Vernon, N.Y. Andrew Schriever and Troy Lipp were successful in defeating these motions, and, as a result, the client has been permitted to continue construction of its building.
